Email Consent Policy
Effective September 25, 2026.
Canada's Anti-Spam Legislation (CASL) covers any email or text that encourages a commercial activity. It requires consent, clear sender identification with a mailing address, and a working unsubscribe honoured within 10 business days.
1. What ListingHQ does
- Every commercial email sent through the Service carries an unsubscribe link, and our sending systems check a shared suppression list first. An address that has unsubscribed is not emailed again.
- Each message identifies the sender by name and includes the realtor's brokerage address.
- A form's newsletter checkbox is separate from the submit button and unchecked by default. Its state is recorded on the lead so consent can be shown later.
- Listing-alert sign-ups require ticking a consent checkbox that names the sender and the emails to expect.
- A direct reply to someone's own enquiry, such as the valuation they asked for, is a response to their request rather than a marketing message.
2. Who is the sender
The realtor whose website collected the address is the sender for CASL purposes, even though ListingHQ operates the sending system. Realtors should therefore:
- send commercial email (market updates, newsletters, new-listing promotions) only to people who agreed through one of their forms, not to someone who made a one-off enquiry without ticking the box;
- treat any automated message they are unsure about as commercial and make sure consent exists;
- respect the unsubscribe list of any provider they connect, such as Mailchimp or Klaviyo, as they would ListingHQ's; and
- know that CASL penalties apply per violation. The indemnity in section 10 of the Terms of Service covers a CASL breach on the realtor's part.
3. Consent wording on customer sites
The newsletter checkbox on customer contact forms reads: “Also send me occasional market updates for this area (separate from a reply to this message. Unsubscribe any time).” It is a separate, unticked checkbox describing the specific email, which is what CASL's express-consent standard tests.
The listing-alert form's checkbox reads: “I agree to receive listing alert emails from [the realtor]. I can unsubscribe at any time.”
4. Proof and expiry
Proof of consent lives in the lead record on ListingHQ and, if a realtor connects their own provider, in that account too. Contacts synced to those providers are tagged as express or implied consent; implied consent generally expires six months after the last enquiry, express consent does not.
5. ListingHQ's own email
ListingHQ sends marketing email only to people who asked for it, and every message carries an unsubscribe link. You can withdraw consent or ask a question through the contact form at listinghq.ca/contact. Effective September 25, 2026.
