Terms of Service
Effective September 25, 2026.
These terms are the agreement between ListingHQ and a real estate professional who subscribes to it. They include the Privacy Policy, the Data Processing Terms and the Email Consent Policy, and the order form you sign.
1. Who these terms are between
ListingHQ is operated by Alexander Mackenzie, carrying on business as ListingHQ, in British Columbia, Canada ("ListingHQ", "we", "us"). "You" means the licensed REALTOR® or brokerage that signs an order form.
The service is a managed website for a real estate professional: hosting, an approved listing feed where one is available, lead capture forms, a private lead dashboard, and the content and search-engine features listed in your order form (the "Service").
You must hold a real estate licence in Canada to subscribe. The Service is offered to customers in Canada. We do not currently accept customers who carry on business in Quebec, because Quebec's privacy law (Law 25) requires compliance work we have not built. This is a scope limit that we will revisit.
2. Your website, your content, our platform
You are responsible for what your website says: your name, brokerage, licence details, and every claim you publish. Real estate advertising rules in your province (BCFSA, RECO, RECA or your regulator's equivalent) apply to your website exactly as they apply to your other advertising.
You are responsible for your login details and for who you let into your dashboard. Tell us promptly if you think your account has been compromised.
Your content, your domain and your brand belong to you. We do not claim ownership of your logo, photos or writing, and we use them only to run your website. You give us a licence to host, display, copy and process your content for that purpose, including generating exports and rendering your listings.
The platform belongs to us: the software, templates, design and infrastructure. You get a limited, non-transferable licence to use it for your own website. You may not resell it, sublicense it, or run it as a service for others.
You are responsible for having the right to use everything you give us, including photos, headshots, testimonials and text.
3. Listing data (MLS® and CREA DDF®)
Listing data on your site comes through CREA's Data Distribution Facility or a board or vendor feed, under their rules, not ours. REALTOR®, REALTORS® and the REALTOR® logo are certification marks owned by REALTOR® Canada Inc. and licensed exclusively to CREA. MLS® and the MLS® logo are trademarks owned by CREA.
Listings are shown only after the applicable feed is approved for your site and connected. If your board approval or feed access lapses or is withdrawn, listing display stops until it is restored. That is outside our control, and it does not entitle you to a refund of fees already paid.
We never display sold prices publicly, and we will not turn on a feature the applicable feed does not permit.
4. Fees and billing
The Growth plan is CAD $299 per month or CAD $2,990 per year, plus applicable taxes (GST/HST and, where it applies, BC PST). There is no setup fee. Your order form states the plan, interval and invoice dates you chose.
Fees are charged in advance for each billing period. The first period is invoiced when the order form is signed.
Board, CREA, feed-vendor, domain and other third-party charges are not included unless your order form lists them. We tell you about any such charge in writing before you are committed to it.
Price lock: the price in your order form does not increase while your subscription stays active and in good standing. If we change our list price for new customers, that change does not apply to you unless you agree to a plan change.
Until card payments are switched on, we invoice you and you pay by the method stated on the invoice. Once card payments are available, they are processed by Stripe; we never receive or store your card number.
If we need to change the terms of an existing subscription, other than list prices for new customers, we give you at least 30 days' written notice.
Invoices unpaid 15 days after their due date may lead to suspension of your site until they are paid. We give you written notice before suspending.
5. Cancelling and refunds
You can cancel at any time, effective at the end of your current billing period. There is no minimum term and no early-cancellation fee. To cancel, send us a message through the contact form at listinghq.ca/contact; we confirm by email.
Fees already paid are not refunded, except where the law requires it.
If we add a subprocessor you object to (see the Data Processing Terms), you may cancel and we will refund the unused part of any annual fee you prepaid.
6. Support and uptime
We monitor the Service and work to keep it available, but we do not promise any particular uptime or service credit for downtime.
Support is by email or the contact form. We reply to every support request within one business day (Monday to Friday, excluding BC statutory holidays, Pacific time). Support is not staffed 24 hours a day.
7. Your data when you leave
For 60 days after your subscription ends, you can ask us for an export of your website content and the leads your site collected, in a structured format sent by a secure method.
After that we delete your data from our active systems, except what we must keep for legal, tax or accounting reasons. Backups age out on their normal schedule; they are not purged on request.
Your domain is yours. Nothing here stops you pointing it somewhere else. We will help coordinate DNS during offboarding.
8. Privacy and your responsibilities as controller
You are the controller of the personal information your website visitors give you (names, contact details and messages). We process it for you under the Data Processing Terms. You are responsible for:
- having a lawful basis to collect and use that information under PIPEDA and any provincial privacy law that applies;
- your brokerage's own advertising, licensing and client-data rules; and
- obtaining CASL-compliant consent before sending commercial electronic messages to anyone the Service helps you collect contact details from (see the Email Consent Policy).
9. Acceptable use
You must not use the Service to publish content that is false, misleading or discriminatory, or that breaks real estate advertising rules, CREA's DDF rules, human rights or fair housing law, or any other law.
We may suspend a site we reasonably believe breaks this section, your brokerage's advertising rules or the feed terms. We give notice and a chance to fix it first where practical. We may act immediately where the problem itself makes waiting unsafe, for example fraud, or a listing-data breach that could put the feed approval at risk.
10. Indemnity
You agree to defend and compensate us against claims and costs arising from: your use of the Service in breach of these terms or the law; content you publish or submit; how you collect, use or contact leads, including any CASL or privacy-law breach on your part; and disputes between you and a third party, including a lead, a client or your brokerage, about your use of the Service. We run the infrastructure; you decide what to publish and who to contact.
11. Limits on liability
To the maximum extent the law allows, our total liability to you for any claim under these terms or about the Service is limited to the greater of the fees you paid us in the 12 months before the claim arose, or CAD $500. We are not liable for indirect, incidental, consequential, special or punitive damages, including lost profits, lost leads or lost data, even if we were told they were possible.
Nothing in these terms limits liability that cannot legally be limited, including for fraud, gross negligence or wilful misconduct, or for death or personal injury caused by negligence.
We do not promise search rankings, indexing, lead volumes, revenue, appointments or transactions. Search engines, AI systems, listing providers, boards, CRMs, registrars and email providers are independent third parties whose decisions we do not control.
12. Governing law and disputes
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Disputes go to the courts of British Columbia, and both of us agree to those courts' jurisdiction. Before starting a claim, each of us will first raise the problem in writing and try in good faith to settle it for 30 days.
13. Changes to these terms
We may update these terms. For material changes we give at least 30 days' notice by email to your account address before they take effect. If you keep using the Service after that date, you accept the change; if you do not agree, you can cancel under section 5.
Anything in your signed order form that conflicts with these terms takes priority over them for your account.
14. Contact
