Express consent

Express consent under CASL is a clear, active opt-in, such as ticking an unticked box, and it lasts until the person withdraws it.

The request has to say what the person is agreeing to receive and who is asking. A pre-ticked box doesn't count, and consent to one thing, like a reply to an inquiry, doesn't stretch to ongoing marketing.

Why it matters to an agent

Express consent is the only kind that doesn't expire, so it's what a long-term newsletter or market update list should be built on.
